At a time when we, in the bordering State of Massachusetts, are both mourning the death of Brooke Bennett at the hands of a multiply convicted, Level 3 classified, child predator from Randolph, Vermont, and expressing our umbrage at the fact we don't have, nor does Vermont have, a death penalty to deal with this.....words fail me...or civil ones at least....so-called human being.

And yet, at the very same time, our State Legislature has before it, yet to be heard, Jessica's Law, so named for Jessica Marie Lunsford, who was raped and murdered by a multiply convicted, Level 3 classified child predator, John Couey.  Jessica's Law, as passed in her native State of Florida, provides for a minimum 25 year sentence for a first time offender.  It has subsequently been passed by 41 other states, leaving only Massachusetts and seven others who have not passed it.

Here you have it folks, tougher sentences for child predators.  Why, you ask, hasn't it passed here?  Quite simply, the Chairman of the Senate Judiciary Committee, Eugene O'Flaherty (D-Boston) refuses to release it from committee.  He is, however, not alone.  Martha Coakley, our esteemed Attorney General, has termed it unenforceable, and has suggested, like the other butthead O'Flaherty, that it infringes on attorneys' and judges ability to plea bargain.

Well, duh, why do you think it is passed? It is designed to limit plea bargains and sentence reductions.  It is designed, instead, to protect children from the selfsame people who would molest and murder them just like that mutt Jacques did Brooke Bennett.  DUH!!!!!

Instead, Coakley, in her inimitable wisdom, has suggested a watered down version...watering down the protection of children from rape....

"Less-ica's Law"....not acceptable in 42 or our 50 states...not acceptable here.

And here we are debating...bemoaning...our lack of a death penalty.  May God have mercy on the Commonwealth.

Chip,

That is, of course, until God forbid something happens to one of their kids or a child in their family. All of a sudden, it would be a different tune! Only their children deserve protection and justice, I guess.

My theory is simple, June...."When we have more fathers and oloder brothers, and less lawyers the world wilo get back to greater sensibiity."

Too many lawyers in the Legislature.

Too many people taking upon themselves to make a decision on what's best for others (regarless of what those 'others' want), without them themselves having any common sense. Too many people just rolling over and allowing those decisions to be made for them. Bad combination.

Give me the choice of June....or the Legislature? I pick June every time!!!

Our legislatue is rotten with defense attorneys. They actually BELIEVE that what they are doing serves the greater good. It just boggles the mind. Chekc out google and see what O'Flaherty said on the Senate floor!! Save the file and listen t it everytime you hae indigestion!!! It is the failsafe cure!

I think it's time for another tea party, folks. Except this time, we dump legislators in the harbor. Especially O'Flaherty and Coakley. Once they're out of our hair, we pass Jessica's Law, with a few minor tweaks. 2nd conviction, proof of more than one conviction, or if murder is involved (even first conviction), it's straight to the island. For good.

I'm not old enough to run yet, June...But, at this rate, look for me in 2016. Not only do we have this travesty they're calling "Jessica's Law", but now the father in Raynham getting busted for trying to protect his 4 year old?

I just heard that story, Xantun. I'm telling you, he's lucky he just walked out of there with a few punches to the head. My husband would have probably ripped his arm out of his socket for touching his child. Shame on Market Basket for continuing to employ him!

June, if that guy had done that to my child, or even a child in my care, there's a good chance that Market Basket would be looking for a new employee, because the guy would be off this planet.

I responded to Adam Pellerin's blog about that one, but I'll repeat part of it here: We need to find this father and elect HIM attorney general! I get the feeling that if more people like him were in charge, we wouldn't be ashamed that the legislature is considering "Jessica's Law", because he'd make damn sure it wasn't gutted!

Elijah was getting ready for work when this was reported, so he didn't get to hear the story. I calmly recounted the facts only, without injecting my own emotions. I asked him what he would have done and his first response was "after I attempt to dispose of him by flushing him down the toilet? Well....let me see......"

Dear Chip,
I can understand the situation that you are talking about and have read this blog, my heart goes out to the family of brooke bennett and nothing is going to bring her back alive,so why don't we have the death penalty in Massachusetts and let me tell you that we in Massachusetts wish that we can get the death penalty but they vote against it. What do you really think in this case. Casimir T.Zigulis
